Attorneys Helping You With A Variety Of Complex Legal Disputes

Magleby Cataxinos & Greenwood is a litigation and intellectual property boutique located in Salt Lake City, Utah. The firm’s practice focuses on two general areas: intellectual property law (including patents, trademarks and copyrights) and complex commercial and business litigation.

The Intellectual Property Group

The Magleby Cataxinos & Greenwood intellectual property group applies for and obtains patents, trademarks and copyrights for the firm's clients, as well as defends and challenges patents, trademarks and copyrights in administrative proceedings before the Patent and Trademark Office (PTO), other administrative tribunals, and the courts.

The firm's patent prosecution group handles all aspects of patent prosecution, including:

  • Prosecution of invention patents
  • Design patents
  • Covered Business Method (CBM) patents

Services include all aspects of proceedings before the PTO, including Inter-Partes Review, Post-Grant Review, Re-examination, and Supplemental Examination. Magleby Cataxinos & Greenwood handles matters before the Patent Trial and Appeal Board, and of course appellate work on patent-related appeals before the Federal Circuit.

The Trial Group

The Magleby Cataxinos & Greenwood trial group provides sophisticated and practical solutions for large and complex disputes, often working in conjunction with the intellectual property group in adversarial contexts, including in patent, trademark, copyright and related litigation. The firm's complex litigation practice also handles trademark, trade secrets, trade dress, computer software and source code, copyright, nondisclosure and confidentiality agreements, noncompetition and noncircumvention cases.

The firm also handles complex business disputes, including:

  • Business torts
  • Contract disputes
  • Partnership disputes
  • Business dissolution cases
  • Closely held corporation or limited liability company litigation
  • Fraud and misrepresentation in business negotiation and agreements

The firm also handles cases involving securities law, securities investigations, SEC matters, and securities litigation. The firm also regularly represents clients in commercial and residential real estate disputes, and construction-related disputes and litigation.

Local and National Reach

The firm’s clients are local, national and international. The firm prosecutes patents and handles litigation for many Utah clients, including some of Utah’s top technology, communications, and biotech companies. The attorneys represent clients in civil and commercial litigation in state and federal trial and appellate courts throughout Utah, including Salt Lake City, Park City, Ogden, Provo, and St. George. They provide clients with powerful advocacy, leveraging their personal and professional qualifications with commitment and authority.

However, the firm’s practice reaches far beyond Utah, or even the Mountain West. The firm’s patent practice generates more work from national and international clients than from within the state. Because of the firm’s location and cost structure, patent prosecution services cost a fraction of that of large west- and east-coast law firms, and the firm offers flat fees (per patent or proceeding), capped fees, or other custom arrangements, on a negotiated-per-client basis. The firm’s trial lawyers regularly handle cases across the country, with the most experience in New York, California and Texas. Many of the firm’s clients have been foreign or international, both for patent prosecution and litigation.

Cost Efficiencies and Advantages of a Mid-Sized Law Firm

Under extreme pressure to lower legal costs in the current economy, companies have been increasingly turning to small firms, like Magleby Cataxinos & Greenwood, to handle outside legal work. See September 2009 publication in the ABA Journal.
